Terms & conditions
Get I.T. Dunn is the trading name of Mr Leum L Dunn (sole trader). The main aim of the business is to offer fast, reliable on-site technical support services to domestic computer users, small businesses, charities and the like who could not normally afford to retain a permanent I.T. Support staff.
Other services include (but are not limited to); general computing advice, tutorials covering various common tasks such as internet usage and email, designing and building computer systems for various applications (including business, gaming and on-board cars, boats and other vehicles), configuring networks and installing software.
In these Terms and Conditions, 'the Customer' refers to the person or business for whom it appears any work is being carried out.
___________________________________________________________________________
1. Mr Dunn shall be entitled to assume that before any work is completed by him that the customer has acquired any licences or permissions necessary for the work to be completed. This includes (but is not limited to) legitimate software licences for software to be installed on computing equipment and permissions to alter buildings (such as drilling holes for cabling) from the owner of the property whether private, council or other interested party as the circumstances might require.
2. Mr Dunn shall be entitled to assume that the person who contacts him to book any work is authorised to do so and that the customer has agreed to pay Mr Dunn's hourly rates of £30.00 per hour including travel time to the place of work from his home address in Norwich (NR5).
3. All invoices are to be paid within 14 days of the work being completed by Mr Dunn to the satisfaction of the customer unless specifically noted on the invoice itself.
4. The customer shall be considered 'satisfied' with the quality of work completed once they have verbally agreed that Mr Dunn has completed the work for which he was originally contracted to do, or if unable to complete said work, once Mr Dunn has provided an explanation for his inability to do so, which is verbally accepted and understood by the customer.
5. Mr Dunn will arrange for at least two million pounds worth of Public Liability Insurance to cover him when working.
6. Mr Dunn will endeavour to arrive on-site at the agreed time and date although some delays cannot be avoided and the customer is expected to allow for this. Should a delay in excess of one hour occur Mr Dunn will contact the customer and offer to re-schedule if the customer prefers.
7. Do not take the p*ss... (unless it's funny).
8. Mr Dunn shall not be liable to the customer as a result of a failure by him to commence work on the agreed commencement date unless previously notified by the customer in writing beforehand that the customer will suffer specific losses in the event of a delayed start.
9. Mr Dunn shall not be liable to the customer for breach of contract in the event of default by him arising from unforeseen ill health or incapacity.
10. If any sum due and payable by the customer to Mr Dunn remains unpaid by its due date (whether demanded or not), the Customer shall pay to Mr Dunn interest on a daily basis for any unpaid sum at the rate currently prescribed by the Late Payments of Commercial Debts Act 1998, if applicable, or, if not applicable, at the Judgement Act 1838 rate.
11. Any dispute or disagreement arising from these Terms and Conditions between Mr Dunn and the customer shall, if Mr Dunn so elects, be resolved by arbitration or mediation.
12. No variation to these Terms and Conditions shall be binding unless agreed in writing between Mr Dunn and the customer.
13. If any provision of the Terms and Conditions is held by a Court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected.
14. The enforcement of and interpretation of these Terms and Conditions shall be governed by the Law of England and Wales and no person or body shall acquire any rights here under by reason of the Contract (Right of Third Parties) Act 2000 as it shall not apply herein.
Addendum:
As of 31st August 2009 there will be a surcharge of £1 added to cheque or cash payment methods. This tariff covers banking charges imposed by NatWest for accepting cash and cheque payments on my account. This surcharge is not imposed on online or BACS payments by NatWest and is therefore not passed on to those customers who pay their invoices using online or automated banking.
